Legal Guarantee
Pursuant to Legislative Decree 206/2005 ("Compliant with the EU Consumer Code") all products ("Products") for sale through the website shop.bio-chemsolutions.com are covered by the Guarantee only if you report the defect within 8 days from discovery. Unless proven otherwise, it is assumed that the Defects of Conformity that occurs within 30 (thirty) days from delivery or supply of the Product, already existed at that date.
Remedies in the event of a defect
In the event of a lack of conformity, the purchaser has the right to refund or replacement, at his choice, without charge in both cases, unless the requested remedy is impossible or excessively expensive for BioC-CheM Solutions compared to the other. In any case, the purchaser will be obliged to make the Product available to BioC-CheM Solutions at its own charge. Once received the product back, BioC-CheM Solutions will proceed with the remedy as described above. Communications will be through the following email address sales@BioC-CheMSolutions.com.
Based on the Legal Guarantee, and on the specific nature of the products (fine chemicals) BioC-CheM Solutions is liable in the following cases:
a) the Product does not comply with the sales contract
b) there is a missing or incomplete update concerning the Product
The action of the purchaser to assert a Conformity Defect not intentionally concealed by BioC-CheM Solutions is prescribed, in any case, within 60 (sixty) days from the moment of supply or delivery of the Product.
Legal Guarantee Exclusions
With reference to the Products, the Purchaser guarantees that i) they are adequate for the purposes for which he intends to purchase them; ii) they are of quantity and have the quality and performance characteristics, also in terms of durability, functionality, compatibility, accessibility, continuity and safety, which are usually found in products of the same type; iii) that does not expect to receive from BioC-CheM Solutions accessories (including but not limited to the packaging) and instructions (including but not limited to those relating to the use of the products) other than those that may be provided pursuant to the contract sales; iv) if it considers that the Products purchased do not comply with any trial or preview version or with a sample or model made available by BioC-CheM Solutions before the conclusion of the sales contract, the purchaser must promptly notify BioC-CheM Solutions at the following addresses: email customer service sales@BioC-CheMSolutions.com.
